    Brittney Griner Is Creating a New Normal, for Herself and the W.N.B.A.

    PHOENIX — Brittney Griner embarked on a four-day itinerary that would disrupt anyone’s circadian rhythm.First came the White House Correspondents’ Association Dinner in Washington, where she was decked out in a sharp, black suit that Saturday night. President Biden pointed to her in the audience and said, “Boy, I can hardly wait to see you back on the court.”Soon she was rushing to catch a flight, landing in Phoenix at 4 a.m. for the start of W.N.B.A. training camp with the Mercury. Then she hustled back east, to New York, for her first Met Gala. She wore a sleek tan suit, and her wife, Cherelle Griner, was in a strapless white gown, both custom outfits by Calvin Klein. They mingled with A-list celebrities that night, but Brittney needed to be back in Phoenix by Tuesday afternoon for more basketball and, she had hoped, a nap.The sparkling events, time-zone hopping and overall spectacle were overwhelming but perhaps also came as a kind of relief for Brittney Griner, who spent nearly 10 months detained in Russia and returned to the United States in December as a new symbol of hope. Ensnared in a geopolitical showdown between Washington and Moscow, Griner drew attention not only to herself and to the plight of other foreign detainees but also to the financial disparities facing women in sports that had brought her to Russia in the first place.On Friday, Griner will return to the court for her first official W.N.B.A. game in 579 days. The league is not the same now, in part because of her. The issues her detention spotlighted are not new and are unlikely to be easily resolved. But she has galvanized a potent fan base and sports work force who are both eager to welcome her home and to use this moment to promote change alongside her.“We have wanted change for a long time, but now we’re really starting to demand it,” Minnesota Lynx forward Napheesa Collier said. “We’re just getting a little more impatient with that and realizing that it’s an issue where we don’t have the money yet, but pushing so that really, really soon we do have the resources to be treated like the athletes we are.”A modest crowd roared for Griner this month during a preseason game, her first action since she was released from Russia.Christian Petersen/Getty ImagesWhy Brittney Griner Was in RussiaRussian customs officials detained Griner at an airport near Moscow in February 2022 after finding vape cartridges with hashish oil in her luggage as she returned to play for UMMC Yekaterinburg, a professional team that reportedly paid her at least $1 million. She was convicted on drug charges and sentenced to nine years in a penal colony, but she was freed in a prisoner swap for Viktor Bout, a Russian arms dealer, in December. The U.S. State Department said that she had been wrongfully detained.The W.N.B.A., now in its 27th season, has long watched dozens of its players go overseas during each off-season in search of higher pay, though the league has been trying to offer them additional ways to make money stateside. The maximum salary in the W.N.B.A. is about $230,000, and was half as much just a few years ago. Top players like Griner, a seven-time All-Star center, can command hundreds of thousands more from international teams. Many people were not aware of this dynamic until Griner’s detention and expressed shock and frustration on social media and on television shows.“As much as I would love to, you know, pay my light bill for the love of the game, I can’t,” Griner said last month during her first news conference since she was freed.The Associated Press reported that 67 of the league’s 144 players still played internationally this off-season, indicative of the strong pull of the opportunity to make additional income. But in light of Griner’s detention and the war in Ukraine, players eschewed the historically lucrative Russian organizations for teams in countries like Italy and Turkey. About 90 players played internationally five years ago.Collier, 26, who has played for international teams in W.N.B.A. off-seasons, said younger players gain important experience overseas. Many W.N.B.A. players have become accustomed to entering the league with less media fanfare and to at times playing before far smaller audiences than they experienced in college.“I’ve been a part of it when I was in college and it was the hottest ticket in the country,” said Mercury guard Diana Taurasi, who starred at UConn before becoming the W.N.B.A.’s career leading scorer. She continued: “How do we make the hottest ticket in the country for the best basketball players in the world in the W.N.B.A.? That, to me, it only happens in women’s sports where the adolescents get more attention than the grown-ups.”Griner, who joined the Mercury in 2013, has been a star since she became known for dunking at Baylor. At her first news conference since returning, Griner pleaded with the unusual swell of reporters to come and cover games during the season, too.“The league is a league that needs celebrity,” said Candy Lee, a professor of journalism and integrated marketing communications at Northwestern. She added: “The league can take advantage of it. The Mercury can take advantage of it.”The surge in W.N.B.A. interest because of Griner has dovetailed with broader momentum for women’s sports in recent years. The N.C.A.A. It has long been a sore point for players, who have had to sleep in airports or rush to games because of delays. This year, it is widely believed that Griner will need to travel privately, though neither the Mercury nor the W.N.B.A. have disclosed her plans.“Would definitely like to make all those flights private,” Griner said. “That would be nice. Not just for me and my team, but for the whole league. We all deserve it. We work so hard. We do so much and it would be nice where we finally get to the point where we get to that point, too.”The W.N.B.A. has said that it cannot afford the tab of over $20 million a season for charter flights, even though some owners might be willing to provide them for their own teams. Charter flights are prohibited in the collective bargaining agreement between team owners and the players’ union as an unfair competitive advantage. The W.N.B.A. fined the Liberty $500,000 for secretly using charter flights to travel to some games during the 2021 season.In April, the league announced that it would have charter flights for teams playing on consecutive days during the regular season and for all playoff games. The W.N.B.A. had made exceptions in similar situations previously.“We’re going to chip away at this as we continue to build this model,” Engelbert said. “Because once you do it, you have to do it essentially for perpetuity, so we want to make sure we’re not putting the financial viability of the league at risk.”On Thursday, the W.N.B.A. players’ union announced a deal with Priority Pass to give players access to airport lounges, which could provide food, spa treatments and places to sleep. Kozar did not expect Griner to announce immediately whether she would again play in the W.N.B.A. But when she returned to the United States, she said she would play.Griner may have been the most plugged-in W.N.B.A. player last season. Players from around the league sent her letters, their only means of communicating with her. In letters with Kozar, Griner was not asking about the organization and its going-ons as much as informing him about them.“It was just a reminder that basketball was one of the things that had been taken away from her, this thing how she impacts the world that’s central to her identity, that so many of her relationships are built around,” Kozar said.Griner will lead the league in hugs this season. She scribbled autographs and posed for selfies in the tunnel of a preseason game against the Sparks in Phoenix last week. It was her first action since she’d returned. A modest crowd cheered louder than it seemed capable of during Griner’s pregame introduction.     The N.B.A. and Its Players’ Union Reach a Tentative Labor Deal

    The collective bargaining agreement, which is said to create a new in-season tournament, must be ratified by the players and team governors.The N.B.A. and the N.B.A. players’ union have agreed to a new collective bargaining agreement that will ensure labor peace, the league announced Saturday morning. The new deal must be ratified by N.B.A. players and the league’s board of governors before it becomes official.The deal includes the addition of an in-season tournament with monetary rewards for players and coaches who win it, the removal of marijuana as a banned substance, and a second luxury tax tier, according to a person familiar with the terms who requested anonymity because the deal is not ratified.The new collective bargaining agreement will begin next season and last for seven years, with a mutual opt-out clause after six years, the same person said.Although some expected that this collective bargaining agreement would lower the age limit for entering the N.B.A. draft from 19 to 18, the sides did not agree to that. The age limit will remain at 19, which means most players coming out of high school will need to wait a year before entering the draft.The league announced the deal in a tweet at 2:59 a.m. Saturday. The parties had agreed to extend the midnight deadline for either side to opt out of the current agreement, which has been in effect since 2017.Had the sides not agreed or come close by Friday, the league intended to exercise the opt-out clause, according to Commissioner Adam Silver. That would have caused the current collective bargaining agreement to expire on June 30 instead of next year, compressing the time the sides would have had to avoid a work stoppage.The N.B.A. has not had a work stoppage since the lockout in 2011, which delayed the start of that season until Christmas.This deal is the first negotiated by executive director Tamika Tremaglio, who began her tenure as the head of the union in 2021, and for CJ McCollum, the Pelicans guard who became its president in August of that year.The second luxury tax tier appears to be a compromise from what the league had wanted. The league had been concerned that some teams were at too great of a disadvantage because a small number of them vastly outspent the others through salary cap exceptions within the existing luxury tax system. This season, the Golden State Warriors and the Los Angeles Clippers are paying luxury taxes and spend far more on their star-studded rosters than any other team. To prevent that spending imbalance, the league had hoped to institute a fixed sum that teams could spend on salaries, but the union made clear early on that it would not accept any hard spending limit for teams.The sides hope the new tier will allow more teams to enter the luxury tax.Adding a tournament during the N.B.A. season had long been a priority for Silver.“It’s something that I remain excited about,” Silver had said during a news conference in September. “I think it continues to be an opportunity within the current footprint of our season to create some more meaningful games, games of consequence, during an otherwise long regular season.” More

    As Bargaining Deadline Looms, N.B.A. and Players’ Union Enjoy Friendly Ties

    The connections between team owners and players are stronger now than in previous years. A deadline to opt out of the current collective bargaining agreement offers a test of that relationship.Tamika Tremaglio, the executive director of the N.B.A. players’ union, organized a friendly social gathering ahead of this season between union officials and N.B.A. league executives: party games, cocktails and even a five-on-five basketball game. They would spend much of the next few months negotiating against each other for the next collective bargaining agreement, and Tremaglio first wanted them to have a little fun together.Tremaglio and N.B.A. Commissioner Adam Silver competed against each other in an egg toss.“For our benefit,” she said, “Adam and I, we didn’t have to play basketball.”The tenor of the relationship between the league and its players’ union seems a far cry from the contentious moments that have dotted their history: the players’ very first attempts to unionize in the 1950s; tense years in the 1990s; and antagonistic battle in 2011 that led to the league’s most recent lockout.Recently, the N.B.A.’s labor landscape has been peaceful, but the strength of that collegiality is being tested by pressure points during a negotiation that has addressed issues like the age limit for players entering the league, a possible in-season tournament and the league’s luxury tax system.One of those pressure points might come this week as the deadline for either side to opt out of the current agreement looms on Friday. Silver said on Wednesday afternoon that he can foresee a deal being reached by Friday, but the league would likely opt out if not. That would make the current collective bargaining agreement expire on June 30 instead of after the 2023-24 season and add urgency to the negotiations for a new agreement. Tremaglio said in a statement that the union does not plan to opt out.“If we don’t have a deal and the league decides to opt out, it will be disappointing considering all the work both sides have put into the negotiations, and the fair nature of our requests,” Tremaglio said.Whatever happens will be set against the backdrop of an era in which N.B.A. players and team owners have largely cooperated, making their dynamic look far different from the labor fights that have played out recently across numerous industries in the United States.People on both sides refer to the relationship between players and team owners as a partnership, and they often develop friendships with each other. During this period, star players have immense power over their careers on and off the court, and the league has benefited from lucrative media rights deals.“It’s not like you can draw a line and say previously it was bad and now it’s good or anything else,” said Jeffrey Kessler, the principal outside counsel for the union, who has been working with the union since 1978. “It just varies over time, shaped by a lot of different forces, shaped by the economics at the time, shaped by the personalities at the time, shaped by the experience. They go through different cycles.”Finances, as they often do with collective bargaining in any industry, have shaped the tenor of the relationship for decades. In 1954, when N.B.A. players first tried to organize, back pay for a group of players was among their top issues. The league recognized the union three years later.Over the next several decades, issues like pensions, free agency and players’ share of league profits became sticking points.“We were the first ones to establish a percentage of the growth revenue going to the players,” Junior Bridgeman, a former player, said, referring to the 1983 C.B.A., two years before he began his tenure as president of the players’ union as the league’s popularity was growing because of Magic Johnson, Larry Bird and Michael Jordan. “No one thought at the time that the numbers would get to where they are today and it would be as meaningful as it is today.”Today, Bridgeman is a business magnate who built a fortune in the food and beverage industry, but when he first attended bargaining sessions, he considered it an unofficial curriculum for a master’s in business administration. He saw what mattered to the team owners and how they communicated.“Most of the meetings ended up being contentious to some extent,” Bridgeman said. He added: “We went to one meeting that lasted all of seven minutes. We got up and walked out. It was the art of negotiation in real life.”In 1995, the league locked out the players for the first time. Union leadership and the league’s representatives had agreed to a deal, but players were unhappy with basic terms and the way the negotiation was conducted. A group of high-profile players filed an antitrust lawsuit and moved to decertify the union.They reached an agreement before the season began, but the deal had an opt-out clause that eventually led to the longest lockout in league history, nearly canceling the 1998-99 season. The sides reached an agreement in January 1999.Silver has worked for the N.B.A. since 1992, spending much of his early years in N.B.A. Entertainment. He became the league’s deputy commissioner, serving under David Stern, in 2006, the year an age limit of 19 went into effect for the draft.The league’s next work stoppage came in 2011. Stern appointed Silver as the league’s lead negotiator for those talks. Silver chuckled at the title.“When David Stern is in the room, he’s the lead negotiator,” Silver said in a phone interview Monday.Stern, who died in 2020, was indeed still the face of those negotiations. His biting wit and tough demeanor led to memorable moments. Billy Hunter, then the union’s executive director, once said he thought the league’s claim that it was losing $400 million a year was “baloney.” Stern, whose family owned a deli, quipped in response: “I grew up at Stern’s delicatessen. He has his meat wrong.”As a player, Michael Jordan had been heavily involved in union battles. His name was on the antitrust lawsuit Kessler filed on the players’ behalf in 1995.In 2010, he became the majority owner of the Charlotte Bobcats, now the Hornets, and took an active role in labor negotiations later that decade. He is now the chairman of the labor relations committee.“The expectation maybe from some people on my side that when Michael was at the table, everything would be hunky-dory,” Silver said. “‘Oh, Michael Jordan is saying it. Therefore that must be a fair position.’”As a player, Michael Jordan, right, helped the league increase its popularity and was active in union battles. As a team owner, he took an active role in labor negotiations in the 2010s.Chuck Burton/Associated PressPlayers, he said, didn’t agree. Silver recalls the star guard Chris Paul, who was the president of the union from 2013-21, telling him: “No question I admire and trust Michael Jordan, but we’re now, in essence, adversaries in this process.”Silver believes the relationship between players and the league is more trusting now than in previous bargaining cycles, in part because the league is more open about its finances.“It doesn’t necessarily mean that it makes it easier to get a deal done,” Silver said. “But we’re now able to jump over what used to be months of back and forth over what the so-called truth was regarding the league’s financials.”Paul, who was drafted in 2005, said he has seen players become more interested and involved in understanding the business of the league now than earlier in his career. Silver has made a point to build personal capital with players. He also fostered a close relationship with Michele Roberts, Tremaglio’s predecessor, who held the post from July 2014 to January 2022. Roberts declined to be interviewed for this story to avoid the appearance she was trying to influence negotiations from retirement.“That’s one of his strengths,” Jerry Colangelo, who was an executive for the Bulls in the 1960s before leaving to work for and later own the Phoenix Suns, said of Silver. “He’s a communicator, a terrific communicator. David was a little bit more arm’s length.” He added: “Both are really good negotiators. Both really could be very tough when they need to be tough. But on a personal basis, Adam is more available.”Both Silver and Paul said that doesn’t mean negotiations are easier.“They always get contentious,” Paul said.Where that productive relationship helps is in times of unexpected upheaval, like when the coronavirus pandemic hit and caused the league to shut down operations in 2020.“The shutting down of the business, playing in a bubble in Orlando, all those things were far outside the scope of our agreement,” Silver said. He added: “The trust enabled us to sit down with the leadership at the union and with the leaders and with the players executive committee, and we worked through some really difficult issues.”Their shared stakes also helped them navigate the work stoppage that occurred in the bubble when players, led by the Milwaukee Bucks, decided not to play after a white police officer in Kenosha, Wis., shot a Black man named Jacob Blake. Before games resumed, players met with team owners over videoconferencing and asked them to commit to support social justice concerns.During the pandemic stoppage, Silver said he and other key league executives began having daily calls with Paul, guard Kyle Lowry and center Dwight Powell, who were part of the league’s competition committee. They checked in on how players were feeling about issues like returning to play, their own safety and the racial justice movements that were sweeping the country.When CJ McCollum replaced Paul as president of the union in August 2021, he was added to those calls. Silver said the calls are no longer daily, but still happen regularly.“We talk about everything,” McCollum, a Pelicans guard, said of his relationship with Silver. “The state of the game, where the game is at, ways to improve.”This season they discussed topics like an uptick in travel calls and changes to foul calls. When the W.N.B.A. star Brittney Griner was imprisoned in Russia, McCollum said they sometimes discussed what they could do to help the efforts to free her.Tremaglio, the N.B.P.A.’s executive director, said the party last fall helped her bolster her relationships with league executives, too.“We are in business together, right? We have a partnership,” Tremaglio said. “For me, I tend to do business with people that I like and know something about.” She added: “I thought it was really critical before we go into negotiations that we had a chance to really get to know one another.”There were some new faces in the union and new faces in the league office, and most of their interactions during the past several months had been held remotely.“I share her view,” Silver said. “I thought it was a great idea.”He added: “When you negotiate with a players’ association, or frankly any collectively bargained relationship, you get a deal done and then the next day you’re dealing with those exact same people and you’re living under that deal.”Tremaglio said the union won the games, though league sources dispute that contention.     With End of Griner’s Detention, a New Wave of WNBA Activism Begins

    With their campaign to free Brittney Griner from prison in Russia over, W.N.B.A. players say they will help free others and focus on women’s health and pay equity.The W.N.B.A. is a trendsetter, a league of mostly Black women who have taken up major progressive causes: voting rights, stricter gun laws, equality for the L.G.B.T.Q. community. But this year’s push to free Brittney Griner, one of their own, from a geopolitical standoff in Russia — that was their toughest test yet.“This is what Black women do,” Natasha Cloud of the Washington Mystics said. “We carry the weight in our family, this country, and we always have, whether we get the acknowledgment or not from it.”Griner was released from a Russian penal colony on Thursday in a prisoner exchange after, the U.S. State Department said, she had been “wrongfully detained” on drug charges for nearly 10 months. Griner is home. Other imprisoned Americans who also may be in danger are not. The W.N.B.A.’s mission continues.“We also want those other prisoners over there to come home as well,” Isabelle Harrison of the Dallas Wings said. “We don’t want them to just be like, ‘Oh, we just got B.G. home, and we’re done.’ No, that’s not what the W does.”In recent years, W.N.B.A. members helped flip a Senate seat in Georgia by supporting the Rev. Raphael Warnock, a Democrat, when Senator Kelly Loeffler, a Republican who owned the Atlanta Dream, spoke against the Black Lives Matter movement. They walked out of games to protest the police shooting of Jacob Blake, a Black man in Wisconsin, and dedicated a season to Breonna Taylor, a Black woman who was killed by Kentucky police.     Landmark labor agreements with members of the men’s and women’s national teams will include higher paychecks and shared World Cup prize money.As the women’s soccer stars stared at their laptop screens Monday night and the new labor deal was explained to them, the numbers just kept climbing. A few thousand dollars here. Tens of thousands of dollars there. Pretty soon, the figures had crossed into the millions.What they added up to, the players all knew, was something many of them had chased for most of their careers: equal pay.That reality arrived Wednesday in landmark contracts with the U.S. Soccer Federation that will guarantee, for the first time, that soccer players representing the United States men’s and women’s national teams will receive the same pay when competing in international matches and competitions.In addition to equal rates of pay for individual matches, the deals include a provision, believed to be the first of its kind, through which the teams will pool the unequal prize money payments U.S. Soccer receives from FIFA, world soccer’s governing body, for their participation in the quadrennial World Cup. The players argued that they had been paid less than their male counterparts for decades even as they won world championships and Olympic gold medals.The fight over per diems and paychecks eventually morphed into a federal lawsuit in which the women accused U.S. Soccer of “institutionalized gender discrimination.” While the women lost in federal court in 2020, when a judge ruled against their core claims, they eventually won their equal pay victory at the negotiating table, with a final assist from the men’s team.It was the men’s team’s players, in fact, who opened a pathway to a deal late last year when they privately agreed to share some of the millions of dollars in World Cup bonus money that they have traditionally received by pooling it with the smaller payments the women receive from their own championship.That split could see the two teams pool, and share, $20 million or more as soon as next year. That will be in addition to match payments that are expected to average $450,000 a year — and double that, or more, in years when World Cup bonus money is added.For the women’s team’s players, Wednesday’s agreements were as much a relief as a triumph. Becky Sauerbrunn, one of the five players who signed the original complaint in 2016, admitted, “It’s hard to get so, so excited about something we should have had all along.”Through the years, as the sides battled in courtrooms and negotiating sessions, the dispute produced sometimes caustic — and personal — disagreements about personal privacy, workplace equality and basic fairness, and drew support (and second-guessing) from a disparate chorus of presidential candidates, star athletes and Hollywood celebrities — not all of them supportive of the women’s campaign for pay equity.The difference in compensation for men and women has been one of the most contentious issues in soccer in recent years, particularly after the American women won consecutive World Cup championships, in 2015 and 2019, and the men failed to qualify for the 2018 tournament. She had been there playing for the professional basketball team UMMC Ekaterinburg during the W.N.B.A. off-season. The news of her detention on Saturday prompted questions about safety and politics but also about logistics — namely: Why was one of the W.N.B.A.’s best players competing in Russia anyway?Griner is a seven-time All-Star, and she won a W.N.B.A. championship in 2014 alongside Diana Taurasi, who has also played in Russia.     The WNBA’s $20 Million Debate Over Charter Flights

    Secret charter flights cost the Liberty a big fine, but players say they deserve them — and need them to be healthy. The league says they’re too expensive for now.The W.N.B.A. said charter flights were too expensive. The players said they did not have to be. The W.N.B.A. commissioner said she wanted them more than anyone. The players said that when they asked for them just two years ago, it felt like the answer was “a hard no.”Now, charter flights for players seem to be closer to a maybe. But that movement has come at a cost — a $500,000 fine for the Liberty, and a bruising of the league’s public image as fans, players and those attuned to drama question whether the W.N.B.A. is doing right by its players.And the cost for the flights? W.N.B.A. Commissioner Cathy Engelbert said the league had estimated that it would cost more than $20 million for all 12 teams to fly by charter instead of commercial airlines for a full season, not accounting for the recent surge in fuel costs and variables such as routes. She has maintained that the league does not have enough revenue to cover the costs. Teams typically play more than 30 games, with half on the road.The players’ union said that it did not have a cost estimate, but that a change in travel accommodations was long overdue.“The league is young, but it’s old enough,” said Terri Jackson, the union’s executive director. “We can figure this out.”An article in Sports Illustrated on Tuesday revealed that the W.N.B.A. had fined the Liberty $500,000 in the fall for secretly using charter flights to travel to some games during the 2021 season. The collective bargaining agreement with the players’ union allows for premium economy seats, such as Comfort Plus from Delta, but charter flights are not allowed and their provision is considered an unfair competitive advantage. The league confirmed to The New York Times that the Liberty had been fined $500,000 for “multiple violations of league rules,” including taking eight charter flights toward the end of the regular season, sending players on a trip to Napa, Calif., and making unspecified “public comments about items that are collectively bargained.”The Liberty declined to comment. A week earlier, Brown tweeted “the wnba” in response to a question about what was holding the league back.“What a joke,” Liberty guard Sabrina Ionescu posted on Twitter with three crying-laughing emojis, in response to a tweet about the Sports Illustrated article.Josh Hart, who plays for the Portland Trail Blazers of the N.B.A., tweeted “This is trash and @WNBA yall got to get better.”Part of the blowback came in response to the assertion by Sports Illustrated that in September, team owners did not support an “unofficial proposal” from the Liberty to make charter flights the default. According to the article, “the Liberty said they’d found a way to get it comped for everyone in the league for three years,” but some owners were worried the players would get used to the flights and want them permanently.But the league was quoted in the article as saying that the Liberty did not make a proposal for the owners to consider, and, in an interview with The Times, Engelbert said a formal proposal “never happened.” She added that if such a proposal were to come, “it would be supported.”“This is a good thing that we have ownership groups that really care, that are investing and are having really good debates,” she said.Whether or not the team owners want charters, the players do. And, in a twist from even five or 10 years ago, they appear to have broad public support as female athletes speak up for themselves and women’s sports get more media attention. For some, the push for charters is about offering accommodations befitting professional athletes — “nice things,” as Brown said. But Jackson said it was mainly about players’ health and safety.“Their bodies are their craft,” Jackson said. They need time to rest, leg room because they are tall and access to nutritious meals to perform at a high level, she said. All of that is compromised by spending hours in airports traveling commercially, sitting in cramped seats and not having proper snacks, she said.It was worse just a few years ago, before the 2020 collective bargaining agreement went into effect with an allotment for upgraded seats. Liz Cambage, a four-time All-Star who is listed at 6-foot-8, tweeted last month that she had paid “out of my own pocket” to upgrade her seats. And yet, even now, players can find themselves stuck in coach.Jackson said teams and the league had blamed overwhelmed staff members struggling to arrange travel and airlines that won’t allow large groups to book upgraded or exit row seats. Bringing the complaints to the league has helped — “Some teams got it together,” Jackson said — but she said the next step would be to file a grievance. The union did not do so last season, but upgraded travel will be a “point of emphasis” this coming season, she said. The league said it was “made aware” of complaints last season and will be auditing teams this season “to assure full compliance.”How soon players can upgrade to charter flights — without teams incurring fines — is unclear because of the players’ and league’s conflicting views on how to pay for them, and when. Engelbert said the $20 million-plus price tag for full-season charters makes it unlikely that a sponsor will pick up the tab, though the league is open to that and the Liberty and other teams are exploring options.“I don’t want to do things that jeopardize the financial health of the league,” she said, adding, “We are trying to build revenue and financial models that support better things for the players in the long term, but this is not something that we can afford today.”Engelbert would not disclose the W.N.B.A.’s revenue or if any teams were profitable, but she said the league was valued at $475 million and at more than $1 billion with the 12 teams included. Last month, the league announced that it had raised $75 million from a group of investors, including Condoleezza Rice and Joe and Clara Wu Tsai. The league had been owned in a 50-50 split with the N.B.A., which founded the W.N.B.A. in 1996. The federation accused the players and their lawyers of cherry-picking figures from an extraordinarily successful year for the women — they had won the World Cup in 2015 — and a U.S. Soccer spokesman called their math “inaccurate, misleading or both.”Offended by the suggestion that their games, and their successes, were worth less to the federation than those of the men’s team, the women and their teammates dug in for a fight.Few knew then how long it would last.Early 2017: An education and a new contract.Becky Sauerbrunn in a match against France in 2017.Robin Alam/Icon Sportswire, via Getty ImagesWithin a year, the players had taken control of their collective fate, firing their union chief and reorganizing their players’ association in ways that gave them a more active role in the issues affecting them.“It was always the plan,” Sauerbrunn, the team captain, said at the time, “to have a players’ association that listens to all the voices of its members and then can take that, and elevate that, and try to make that a reality.”Receiving a high-speed education in topics like labor law and public relations, the players voted one another onto negotiating teams and subcommittees and — between camps and full-time jobs as professional athletes — threw themselves into the task of negotiating a new collective bargaining agreement with U.S. Soccer.Uniting disparate teammates through text messages, overnight emails and anonymous player surveys, they determined priorities for a new contract and then made their cases personally in negotiating sessions with the federation and its lawyers.Within a few months, they had a deal.The agreement includes a sizable increase in base pay for the players — more than 30 percent, initially — and improved match bonuses that could double some of their incomes, to $200,000 to $300,000 in any given year, and even more in a year that includes a World Cup or Olympic campaign.The agreement largely sidestepped the broader equal pay fight that the women had made the cornerstone of their cause. The players were able to not only take pride in gains on salaries and bonuses, but also in having won control over some licensing and marketing rights that the union saw as an opening to test the team’s value on the open market.March 2019: Same fight, new forum.Labor peace did little to move the sides closer to an equal pay agreement, so in March 2019 the players withdrew their E.E.O.C. complaint and significantly raised the stakes by suing U.S. Soccer for gender discrimination.In their filing and a statement released by the team, the 28 players described “institutionalized gender discrimination” that they say has existed for years.The discrimination, the athletes said, affects not only their paychecks but also where they play and how often, how they train, the medical treatment and coaching they receive, and even how they travel to matches.The suit brought the fight to a new forum but also presented new hurdles. The players now not only had to prove that their team and the men’s national team did the same work, they also had to overcome questions about the differences in their pay structures and their negotiated collective bargaining agreements. And the C.B.A. they fought so hard to win suddenly left them without one bit of leverage: The players were forbidden by its terms to strike at least until it expired at the end of 2021.July 2019: Stadium chants and parade taunts.Fans cheered at a parade for the U.S. women’s team as they celebrated their World Cup victory in 2019.Damon Winter/The New York TimesIn the summer of 2019, a fight that had played out in public statements, social media hashtags and white T-shirts for more than three years moved to its biggest stage to date: the Women’s World Cup in France.By then, the U.S. national team’s stars were fighting not only their federation and others opposed to their equal pay claims, but also a sitting U.S. president, critics of their victory margins and those who didn’t appreciate their goal celebrations. When it lifted the trophy, though, all the team had was friends.The chant was faint at first, bubbling up from the northern stands inside the Stade de Lyon. Gradually it grew louder. Soon it was deafening.“Equal pay!” it went, over and over, until thousands were joining in, filling the stadium with noise. “Equal pay! Equal pay!”A few days later, fans repeated the chant as the U.S. Soccer president Carlos Cordeiro feted the team after its victory parade in New York.February 2020: The price of peace? $67 million.Among the voluminous filings before the women’s case was heard in federal court last year were two notable ones seeking to end it outright.In separate requests for summary judgment — the process in which each side claims its case is so strong that the judge should rule in its favor — U.S. Soccer and the players showed just how far apart the players and the federation remained not only in what they considered a fair outcome, but also in their basic concepts of what constituted equal pay, despite years of litigation, depositions and public relations campaigns.U.S. Soccer asked for a simple declaration that the players’ claims were without merit; simultaneously, the players finally put a price tag on what they considered a fair outcome:The federation sought to avoid a looming gender discrimination trial by asking the judge to dismiss the players’ claim. The women’s players also asked for a pretrial decision, but on far different terms: They are seeking almost $67 million — and potentially millions more — in back pay and damages.March 2020: The fight gets ugly.While Rapinoe had offered an olive branch at the victory parade, hinting at the idea of a settlement on points on which the two sides agreed, that hope was gone months later.The spark was a court filing in which U.S. Soccer, through its lawyers, argued that “indisputable science” proved that the players on its World Cup-winning women’s national team were inferior to men.Carlos Cordeiro resigned after U.S. Soccer argued through its lawyers that women’s players were inferior to their men’s counterparts.Charles Rex Arbogast/Associated Press“I know that we’re in a contentious fight,” Rapinoe said, “but that crossed a line completely.”U.S. Soccer fired its lawyers, but the damage was done. After unsuccessfully trying to manage the fallout, Cordeiro resigned. Talks of a settlement that might have headed off the march to federal court fell apart.April 2020: A crushing defeat for the players.The ruling in the lawsuit, when it came, was devastating for the players. The judge, R. Gary Klausner of the United States District Court for the Central District of California, granted the federation’s motion for summary judgment. But he went further: He declared that the women’s core argument — that they had been paid less than players on the men’s national team — was factually wrong.In his ruling, the judge dismissed the players’ arguments that they were systematically underpaid by U.S. Soccer in comparison with the men’s national team. In fact, Klausner wrote, U.S. Soccer had substantiated its argument that the women’s team had actually earned more “on both a cumulative and an average per-game basis” than the men’s team during the years at issue in the lawsuit.The brutal irony, of course, was that in going to court against U.S. Soccer while they were at the peak of their powers, the women’s team had also picked the absolute worst time to line up a few years of their salaries against a few years of the men’s pay.Since February 2015, the agreed-upon start of the class-action period in the case, the women’s team had won two World Cup titles (and millions in bonus payments for those triumphs) and other major salary gains by negotiating a new collective bargaining agreement. During the same period, the men’s team had plumbed new lows, with its failures serving to cripple the women’s case.By failing to qualify for the only men’s World Cup played during the class window, the men became ineligible for millions of dollars in performance bonuses of their own. Those payments would have swelled their paydays from U.S. Soccer far beyond what the women could ever have earned.A chance to salvage something from defeat?It was, a day later, hard to overstate the weight of the court decision. Judge Klausner had not only ruled against the players’ arguments; in effect, he had said they could never win. Yet even though U.S. Soccer’s victory in court was complete, and the players immediately announced their intention to appeal, the federation signaled just as quickly that it was still happy to discuss a way out.“We look forward to working with the women’s national team to chart a positive path forward to grow the game both here at home and around the world,” it said in the briefest of statements after the ruling.Cindy Parlow Cone, who replaced Cordeiro as president of U.S. Soccer, signaled a willingness to continue negotiations with the players.Charles Rex Arbogast/Associated PressThe federation’s words seemed carefully chosen. The seemingly endless battles with its most popular players have unquestionably damaged — and continue to damage — U.S. Soccer’s reputation. The dispute has even brought it into conflict with its own sponsors.But much has changed since the equal pay war began: U.S. Soccer has a new president, the former women’s player Cindy Cone, and a new chief executive, and neither of them could reasonably be tied to past missteps and injustices.For them, and for U.S. Soccer, rebuilding a functional relationship with the women’s team — the federation’s most valuable asset and a critical moneymaker in troubled economic times — should be a top priority. If that means eating some crow and cutting a check to signal an eagerness to move forward, it might even work.November 2021: A small victory, and a new start.In November of last year, U.S. Soccer and the players reached an agreement that resolved claims about unequal working conditions. The deal, a rare moment of détente in the yearslong fight, formalized an effort the federation had already begun to remove differences in areas like staffing, travel, hotel accommodations and venue choices related to men’s and women’s national team matches. But it was a necessary step for the players before they could appeal their larger defeat in federal court.For the players and their lawyers, the agreement brings opportunity: In settling their issues related to working conditions, the women’s stars cleared the way to appealing a judge’s decision in May that had rejected most of their equal pay claims. For the federation, removing one of the last unresolved items in the team’s wage-discrimination lawsuit allowed its new leadership team to rid itself of one more point of contention in a dispute they would prefer to see end, and to signal that U.S. Soccer is open to more accommodations.U.S. Soccer’s president, Cindy Parlow Cone, hailed the agreement, saying it signaled the federation’s efforts “to find a new way forward” with the women’s team and, hopefully, a way out of the rest of the litigation.“This settlement is good news for everyone,” Cone said, “and I believe will serve as a springboard for continued progress.”Tuesday: The fight ends at last.Tuesday’s settlement between the women’s players and U.S. Soccer includes $24 million in compensation for the athletes — largely back pay for dozens of players who were included once the plaintiffs were granted class-action status, and several million dollars in seed money for a fund that will be available to players for post-career plans and initiatives to grow the women’s game.It also includes a pledge from U.S. Soccer to equalize pay, appearance fees and match bonuses for the women’s and men’s national teams for all games, including the World Cup, in the teams’ next collective bargaining agreements.That last bit is the stage for the next fight: Both the men’s and women’s teams are playing under expired — and separate — agreements. Negotiations on new ones are ongoing. It’s not clear when a deal will be struck. More
